Do I Have A DUI Defense? In Almost Every Case, The Answer Is YES!
DUI defense is a very technical area of law. A lawyer must scrutinize every single aspect of the stop, arrest and processing.
I am attorney Matt Andrews in Evans, Georgia. Through years of experience as a former prosecutor, I have been trained to recognize whether the proper procedures were followed and what it means for the case.
Common Challenges To A DUI
Even if you’re afraid that you may be convicted of a DUI, don’t give up. I can still defend your case in court. At the time of arrest and throughout the legal process, the police must follow specific procedures and the equipment must be maintained in a very specific way.
Based on this, I may still be able to defend you by evaluating certain aspects of your situation, including:
- Whether the officer had reasonable suspicion to stop you
- The scope and duration of the stop
- Whether the officer gave proper instructions during evaluations
- Whether the field evaluations were conducted properly
- The sufficiency of any other evidence the state may have
These are just a few examples of what can be challenged but there are many more. I know the law and can help you get the best results possible through a thorough, detail-oriented approach to your case. I scrutinize every one of these things, and much more, in every DUI case I handle.
What About My Administrative License Suspension (ALS) Hearing?
In Georgia, you don’t have to be convicted of a DUI to have your license suspended. The DUI arrest alone triggers an automatic 12-month license suspension through the Department of Driver Services (DDS). You have 30 calendar days from the date of arrest to request an ALS Hearing to fight this suspension.
However, a criminal defense attorney experienced in DUI law will know how to best handle your ALS hearing to try and protect you from consequences such as a license suspension. Contact me immediately to ensure you don’t miss the deadline to request this hearing.
